These Terms & Conditions ("Terms") govern the use of the Like Magic employee-monitoring and IT remote-support software and admin portal (the "Service"), provided by Pro Media Mogul trading as "Like Magic". By registering an account, purchasing a subscription, installing the Like Magic desktop agent, or ticking "I agree to the Terms & Conditions" during setup, you accept these Terms. If you do not agree, do not install or use the Service.
Like Magic is a workplace analytics and IT-support tool. Installed on an employee's work device, it: logs work sessions, breaks and active-window/application usage; captures periodic screenshots and, during working hours, a live screen view; and provides authorised IT support personnel with the ability to remotely view and control the device to keep it running, updated and secure ("Remote Support"). Once installed, the Like Magic agent runs automatically in the background whenever the device is in use.
The Service may only be installed on devices that are owned by, or lawfully controlled and administered by, the employer as company equipment and issued to a user for work. It must not be installed on personal, privately-owned, BYOD or household devices. The customer-company deploying the Service is solely responsible for deciding who is monitored, which features are enabled, and who may exercise Remote Support.
During active work sessions, the Service may collect:
The Service does not capture continuous video, webcam or microphone input. It runs automatically in the background whenever the device is in use.
Authorised IT support personnel of the customer-company may remotely view and take control of the device to provide technical support, apply updates, and maintain security and availability. So that support can be provided even when the user is away from the device, a Remote Support session may begin without an on-screen prompt. Users should therefore treat the device as one that may be accessed at any time for legitimate business, support and security purposes, and should avoid using it for private accounts or personal matters they wish to keep confidential. Every Remote Support session is logged.
Like Magic is committed to lawful, transparent monitoring under the Protection of Personal Information Act, 2013 ("POPIA"). On a company device that is monitored, a user retains a reduced and limited expectation of privacy — not a complete absence of privacy. For the purposes of POPIA, the customer-company is the Responsible Party that determines why and how monitoring occurs, and Like Magic acts only as its Operator, processing information on the customer's documented instruction. The customer-company is responsible for giving employees the required notice, maintaining a workplace monitoring policy, establishing a lawful basis, and obtaining any consents required by POPIA and South African labour law. Data subjects retain their POPIA rights, including the right to access their information and to lodge a complaint with the Information Regulator.
The customer-company and its administrators agree to use the Service only for lawful purposes on eligible company devices, in compliance with POPIA, RICA and applicable labour law, and only after giving employees appropriate notice. Covert or unlawful surveillance is prohibited. The customer-company alone decides, and is solely responsible for, how it deploys and uses the monitoring and Remote Support features.
Corporate clients must create an administrator account and provide accurate details. You are responsible for the security of your account and for all activity under your administrative domain and user logins.
Subscriptions are billed monthly at a per-user rate, with no setup fee:
Payments are captured securely via Paystack (in ZAR). Subscriptions renew monthly until cancelled by the client administrator.
All intellectual property rights in Like Magic belong to Pro Media Mogul, except for third-party open-source components distributed with the Service under their own licences (including the RustDesk remote-access component, licensed under the GNU AGPL-3.0). Nothing in these Terms limits your rights under those open-source licences.
The Service is provided on an "as is" and "as available" basis. Like Magic and Pro Media Mogul make no warranties, express or implied, regarding uptime, reliability, accuracy of telemetry, fitness for a particular purpose, or the legal compliance or admissibility of any monitoring the customer chooses to perform.
To the maximum extent permitted by South African law, Pro Media Mogul and Like Magic shall not be liable for any indirect, incidental or consequential damages, including downtime, loss of logs, or employee disputes. The customer-company indemnifies Pro Media Mogul and Like Magic against any claim arising from the customer's deployment, configuration or use of the Service, including any claim by an employee or regulator relating to monitoring or Remote Support.
These Terms are governed by the laws of the Republic of South Africa, and any dispute is subject to the exclusive jurisdiction of the South African courts.
